NOTICE
Pluckit is licensed, not sold, by The NetWork and protected by United States copyright law (and international treaties).
By using this software, you signify that you have accepted this Agreement's terms.
Complete details about your rights and obligations and those of The NetWork are in the Agreement below, which we ask that you read now.
The specific limitations on your remedies and The NetWork's warranties and liability are in the Agreement below.
The NetWork hopes that you will accept the License and Warranty Agreement so that you can use, enjoy, and benefit from Pluckit.
LICENSE AND LIMITED WARRANTY AGREEMENT
Note: The NetWork does not represent any Internet service provider. This Agreement does not in any way alter any relationship(s) you may have with any Internet service provider.
Pluckit is not shareware. It is software that is distributed via electronic means in an unregistered, demonstration format. A registration code must be obtained from The Network to convert the unregistered demonstration form of Pluckit into the registered, fully-functional form.
Pluckit is not sold. It is licensed by The NetWork to the original customer and to any subsequent licensee for use only on the terms set forth below.
BY USING OR REGISTERING THE SOFTWARE, WHETHER YOU DOWNLOADED IT OR IT ACCOMPANIED YOUR HARDWARE, YOU ARE ACCEPTING THE TERMS OF THIS AGREEMENT. Any questions concerning this Agreement should be referred in writing to The NetWork, Attn: Licensing Dept., 401 Jim Wright Freeway, Suite 109, Fort Worth, TX 76108.
I. LICENSE FOR PLUCKIT
A. YOU MAY:
1. Make as many copies of the UNREGISTERED DEMONSTRATION FORM of Pluckit and documentation as you wish; give exact copies of the original UNREGISTERED DEMONSTRATION FORM to anyone; and distribute the UNREGISTERED DEMONSTRATION FORM of the software and documentation in its unmodified form via electronic means.
2. Install and use the UNREGISTERED DEMONSTRATION software on any computers under your immediate control.
3. Terminate this license by destroying the original and all copies of the software in any form.
4. Make a backup copy of the REGISTERED form of Pluckit to protect your investment.
B. YOU MAY NOT:
1. Loan, rent, lease, give, sub-license or otherwise transfer the REGISTERED FORM of Pluckit or its registration code (or any copy), in whole or in part, to any other person or entity.
2. Distribute the REGISTERED OR UNREGISTERD FORMS of the software and/or documentation with other products (commercial or otherwise) without the prior written permission of The NetWork.
3. Loan, rent, lease, give, sub-license or otherwise transfer the software (or any copy), in whole or in part, to any other person or entity, except as noted in paragraph A.1 ("Copy") above.
4. Copy or translate the software, except as noted in paragraph A.1 above.
5. Copy or translate any of the User documentation (whether paper or electronic) included with the software, except as noted in Paragraph A.1 above.
6. Make any alterations or adaptations to the software.
7. Decompile, disassemble or otherwise reverse engineer the software.
8. Use the REGISTERED form of Pluckit on more than one computer. A separate license is required for each computer that Pluckit resides upon.
This license will terminate automatically if you fail to comply with the terms and conditions set forth above. Such termination shall be in addition to and not in lieu of any other remedies available to The NetWork.
II. LIMITED WARRANTY
A. You assume full responsibility for the selection of the software, and for its installation and use and the results of that use.
B. While every reasonable effort has been made to insure that you will receive software that you can use and enjoy, The NetWork does not warrant that the functions of the software will meet your requirements or that the operation of the software will be uninterrupted or error-free.
C. This Limited Warranty does not cover any software which has been altered or changed by anyone other than The NetWork.
D. The NetWork is not responsible for problems caused by changes in the operating characteristics of the hardware or operating system software you are using which are made after the release date of this version of the software, nor for problems in the interaction of this software with other software, nor for the availability or performance of any on-line service or Internet service which you may choose to access.
E. EXCEPT AS SPECIFIED ABOVE, THERE ARE NO WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some states do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.
F. IN NO EVENT WILL THE NETWORK BE LIABLE TO YOU, YOUR COMPANY OR ANY OTHER PARTY FOR DIRECT, INDIRECT, GENERAL, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR SIMILAR DAMAGES ARISING FROM THE USE OF, OR INABILITY TO USE, THE SOFTWARE OR FROM THE NETWORK'S BREACH OF THIS WARRANTY, EVEN IF THE NETWORK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above exclusion or limitation may not apply to you.
G. In no case shall The NetWork's total liability exceed the amount you paid in license fees for the right to use a single copy of the software. The NetWork's software pricing reflects the allocation of risk and limitations on liability contained in this Limited Warranty.
H. This warranty gives you specific rights and you may also have other rights which vary from state to state.
I. No action for breach of warranty may be commenced more than one (1) year following the expiration date of the above Limited Warranty.
This Agreement shall be treated as though made and performed entirely in Tarrant County Texas. Any action under it shall be governed by the laws of Texas and the United States. This Agreement constitutes the entire agreement between you and The NetWork independent of any previous statements or writings by anyone. Should any of this Agreement's provisions be held void or ineffective, all others will remain in effect. Pluckit is a copyrighted work, protected as such under the laws of the United States and international treaties.
U.S. Government Restricted Rights
This software and documentation are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to the restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software * Restricted Rights at 48 CFR 52.227-19, as applicable.
